Interpretation:

‘Company’ refers to Essex DJ Limited, 11 Peartree Business Centre, Peartree Road, Stanway, Colchester , CO3 0JN

‘Customer’ refers to a person or persons who places an order for product(s) via the internet or by telephone.

‘Courier’ refers to a company appointed by the Company for the purpose of delivering goods.

‘Goods’ refers to a product or products for sale or sold by the Company to the Customer.

‘Order’ refers to a collection of goods or products which has been specifically requested either verbally, in writing or transmitted by electronic means from the Customer to the Company

General:

These terms and conditions are constructed in accordance with and subject to the Law of England, the Consumer Protection (Distance Selling) Regulations 2000 and do not affect the statutory rights of the Customer.

No variations or additions to these Terms & Conditions will be permitted or accepted unless specifically agreed in writing by a Director of The Company.

Placing An Order:

The Customer should satisfy themselves regarding the requirements or compatibility of any item before placing an order.

If in the event of temporary stock shortage, the Company reserves the right to dispatch an order in 2 or more parts. In this event any following part orders will be delivered to the same delivery address free of charge and as soon as stock levels permit.

The Company will endeavour to inform The Customer if an item is out of stock at the time of ordering, or (if after normal working hours) the next working day. If the order is for new / pre release goods, The Company shall hold the order until complete and ready to dispatch unless The Customer agrees to pay an additional carriage charge for the remaining order.

Orders which have been placed, cleared and accepted by 2.00pm Monday to Friday will usually be dispatched the same day for usual next working day delivery to Mainland UK. Orders received after 2.00pm will usually be processed the next working day. Any orders received after 2.00pm Friday will be processed the following Monday. Please note that the definition ‘Monday to Friday’ does not include any Public or Bank Holidays.

Any product descriptions and images advertised on The Company’s web site or printed literature were correct at the time of publication. It is The Customer’s responsibility to check regarding any product variations with The Company at the time of ordering.

Pricing & Payment:

The Company accepts payment by cash (by registered post please), personal / business cheques / bankers drafts payable to ‘Essex DJ’, by telephone via debit / credit card, by automatic bank transfer or online via Paypal, the safe online payments system that allow The Customer to pay with a credit / debit card or from The Customers Paypal balance.

All orders must be accompanied with full payment unless agreed in writing by a Director of The Company.

The Company does not levy a surcharge for payment by credit / debit cards or Paypal.

Orders can only be sent to the billing address of the cardholder placing the order.

In order to keep prices competitive, The Company reviews our pricing periodically. All prices and products are subject to change without notice and are subject to stock availability.

The Customers credit / debit card will be debited at the time of order to secure the goods.

Please allow up to 7 working days for cheque clearance before the goods are dispatched.

Bankers drafts, building society cheques and postal orders are acceptable for instant clearance.

Personal or business cheques may be express cleared through The Company’s business bank account for an additional £15.

To pay by electronic bank transfer or to pay by cash directly into The Company’s bank account please call Essex DJ on 01206 762999 during shop hours.

The Company will not dispatch any orders until full payment has been received and cleared.

All prices quoted are inclusive of VAT @17.5% unless otherwise stated.

Delivery Options & Costs:

The Company will endeavour to process all orders, where possible, within 24 hours. Whilst most items will be despatched for delivery the next working day (Monday to Friday), please allow up to 3 days for delivery within the UK.

The Company will not accept any orders or deliver to any address outside the UK, or to the Channel Islands, P.O. Box numbers or BFPO addresses.

Delivery is free for all orders over £100 to most mainland UK addresses. There is a small delivery charge of £9.95 for all orders under £100.

Deliveries to UK offshore, Northern Ireland and remote Scottish Highlands will incur an additional delivery charge of £17.63

AM morning (before 12.00) and PM Afternoon (12.00 - 5.30) delivery options are available to most mainland UK addresses at a cost of £15.00 extra

Saturday morning (before 12.00) delivery option is available at a cost of £12 extra but is not available to non-mainland locations and remote Highlands.

Smaller items that are sent by normal post are not subject to an additional carriage charge.

Any consignment returned The Company by a courier as a ‘failed delivery’ due to a The Customer not able to accept or refusing delivery of goods and are subsequently returned to The Company will be subject to an additional carriage charge equal to the original carriage charge for re-delivery.

Title and Responsibility Of Goods:

The title of the goods shall not pass from The Company to The Customer until full cleared payment has been received. The Customer shall become responsible for the goods from the time of delivery and liability to insure the goods then becomes that of The Customer.

Cancellation Of Orders:

Goods are not sold on a trial basis. However, if the Customer is not happy with the purchase, please return to The Company within 7 days of receipt.

The Company will make a refund (by the original payment method), provided the goods are returned in perfect condition and in their original unopened packaging. Please return the delivery note with the item(s) and state the reason for the return.

The Company does not refund any delivery costs on items returned as unwanted.

Pre-recorded CD’s, DVD’s, vinyl and computer software cannot be returned for a refund unless proved faulty.

Shortages & Faulty Items:

Any claims for non-delivery, damage in transit, faulty from new or missing items must be submitted to The Company in writing within 7 working days of delivery. Claims will not be accepted after this time.

The Company will arrange for collection of any faulty, damaged or missing item and the subsequent replacement of this item on a like for like basis. If the same item is out of stock, The Company will substitute the item with one of equal or greater value but will endeavour to liaise with The Customer at all times regarding this eventuality.

Warranty:

All goods are covered by 12 month manufacturers warranty unless specifically stated. Exceptions to this warranty are consumable items including lamps, styli, batteries, crossfaders, etc.

The warranty will be rendered invalid if an item has been modified or tampered with in any way.

Insurance & Liability:

All orders dispatched by courier are insured by the courier whilst in transit and will require a signature at the point of delivery. If delivered by Courier, goods will not be delivered to a third party address or without a signature without the express joint consent of the Customer and The Company.

Small orders will (at the discretion of The Company) be dispatched by Royal Mail.

The Company cannot be held responsible for any claims arising from delayed delivery or faulty goods for any loss of earnings or event cancellations which depend on the order or part of the order arriving for a specific date(s).
